Terms of Service

These Terms of Service ("Terms") govern your access to and use of MyVisito, a digital business card service operated by EmodeFlow, LLC ("we", "us", "our"), a company registered in the United States. By creating an account or using the service you agree to these Terms.
Please read these Terms carefully. They include an arbitration agreement and a class action waiver in the "Dispute resolution" section that affect how disputes between us are resolved. If you are a consumer in the European Union or EEA, the United Kingdom, or Israel, that section does not limit the mandatory rights your local law gives you.
The service
MyVisito lets you create, edit, publish, and share digital business cards, including AI-assisted generation of card content and design. We keep improving the service, and we may add, change, or remove features over time. Where a change is significant, we will take reasonable steps to let you know.
Eligibility and your account
- You must be at least 16 years old to use MyVisito.
- If you use MyVisito on behalf of a business or another person, you confirm that you are authorized to accept these Terms on their behalf.
- You must provide accurate information and keep your login credentials secure. Actions taken through your account are your responsibility.
- You may create as many draft cards as you like; how many you can keep published at once depends on your plan. On the Business and Enterprise plans, each team member is an authorized user who occupies a paid seat. Your account and any seats are for you or your organization, and may not be sold, shared, rented, or transferred to others.
- You confirm that you are not located in, and are not on any sanctions or restricted-party list of, a country or territory subject to comprehensive government sanctions, and that you will not use the service in violation of any applicable export-control or sanctions laws.
Your content and the license you give us
You keep full ownership of the content you add to your cards. You grant us the limited, non-exclusive, worldwide, royalty-free license needed to host, store, display, and share that content so the service can function, and nothing more. This license ends when you delete the content or your account, except for copies we are required to keep by law or that remain in routine backups for a limited period.
You are responsible for the content you publish: that it is accurate, that you have the rights and any consents needed to use it (including for photos, logos, and any personal details of other people you add), and that it does not violate any law or the rights of others.
When visitors submit their details through a lead form on your card, you are the party responsible for that information (the data controller). You must have a lawful basis to collect and use it and, where the law requires, provide those visitors with your own privacy notice. We handle that information on your behalf, as described in our Privacy Policy.
When you import content into a card using a link, a photo, or a file (for example the import that builds a card from your existing website), you confirm that you own that content or are authorized to use it, and the imported result is treated as your content under this section.
AI-generated content
The copilot generates card content and design based on what you tell it. The same applies to every other AI feature in the service, including help with writing product descriptions and building course outlines in the shop. AI output is provided as is, may contain mistakes or inaccuracies, and does not constitute legal, financial, medical, or other professional advice. Review AI output before publishing or selling with it: you are responsible for everything that appears on your published card and product pages, including any claims they make.
The text, images, and files you provide to the copilot are sent to our AI provider only to produce the result you requested. They are not used to train AI models. Do not submit other people’s sensitive personal information to the copilot unless you are permitted to.
Acceptable use
We may suspend, limit, take cards offline on, or terminate any account that violates these rules, or that we reasonably believe is being used to resell the service, to serve third parties outside your organization, or to get around our pricing. Where the issue is not a security or legal risk, we will, where reasonable, warn you first and give you a chance to put it right, for example by moving to the correct plan or buying the seats your use needs. Where we reasonably suspect a serious breach, we may suspend access while we look into it.
- No impersonating another person or business, misrepresenting your affiliation, or publishing a card that carries the name, likeness, or contact details of a real person without their consent. Each card must represent you, or a person or organization you are authorized to represent.
- No unlawful, harassing, misleading, defamatory, hateful, or infringing content.
- No content promoting illegal goods or services, adult content, or anything that endangers minors.
- No spam, phishing, malware, or attempts to interfere with, overload, or disrupt the service or its security.
- No automated scraping, reverse engineering, or circumventing the limits or protections of the service.
- No using lead details or other people’s data collected through the service in a way that breaks the law or those people’s rights.
- No reselling, sublicensing, or offering the service to others as your own without our written permission.
- No operating the service as a service bureau, agency, or reseller to create, publish, or manage cards on behalf of people or businesses who are neither you nor paid members of your own workspace. Managing cards for your own team is fully supported on the Business and Enterprise plans, where each team member occupies a paid seat you buy; serving third parties outside your organization requires a separate written agreement with us.
- No structuring your use to get around our pricing, for example using a single account or seat, or extra accounts, workspaces, or cards, to serve people who each should have their own plan or seat.
- Features described as "unlimited" are for normal use by you or your own team of the size you pay for, not for redistribution or resale. We may apply reasonable limits to use that is inconsistent with that.
Public cards, search engines, and third-party links
A card is public only when you choose to publish it. A published card lives at a public web address with no login required, so anyone who has the link, scans its QR code, or finds it online can view it and save its details.
When you first publish a card, you choose its search visibility, and you can change that choice at any time in the editor. The default is PUBLIC: search engines and other services (such as Google) may crawl, index, cache, and display the card and its content in search results, previews, link summaries, and archives, and social platforms and messaging apps may generate their own previews of it. This is a normal part of publishing on the web, and by publishing a card with the public setting you agree to it.
You can instead choose PRIVATE, for the whole time the card is published or starting at any later moment. Private means we ask search engines not to index the card (a standard "noindex" signal) and we leave it out of our sitemaps. Private is not a lock or a password: the card remains reachable by anyone who has its link or scans its QR code, and while mainstream search engines honor noindex signals, we cannot guarantee that every crawler or service will. If a card was public and indexed before you switched it to private, it may keep appearing in search results and caches for some time until search engines re-crawl and drop it.
Once a card is public, its content can also be viewed, copied, screenshotted, cached, or re-shared by other people and services, and copies may continue to exist elsewhere (for example in search-engine caches or web archives) even after you change, unpublish, or delete the card, or switch it to private. Those copies are outside our control and we cannot guarantee their removal.
You can unpublish a card at any time from your account. Unpublishing takes the card offline on our service and, over time, asks search engines to drop it, but removal from third-party caches, archives, and copies is up to those third parties, is outside our control, and is not something we promise. For that reason, do not put anything on a published card, about yourself or anyone else, that you are not comfortable being fully public.
We do not verify the identity of cardholders or the accuracy of the information on any card, and we do not endorse any card or the people or businesses behind them. Any dealings you have with a cardholder, or with a visitor who submits their details to your card, are between you and them and are at your own risk.
Cards can include links to third-party services, such as social profiles, booking pages, and payment links. We do not control or endorse those services, and we are not responsible for them. Your use of them is subject to their own terms.
The service can also connect to third-party tools you choose, such as CRM systems, spreadsheet and automation services, calendars, and payment providers, and can show listings of third-party events. Those tools and events belong to their providers and organizers: their own terms and privacy policies govern them, we do not endorse them or guarantee their accuracy or availability, and data you choose to send to them leaves our service at your direction and under their policies.
Event discovery
MyVisito includes an event discovery feed that shows professional events and meetups collected from publicly available listings around the web, with the name of the source and a link to the event’s own page. We display these events for discovery only: we are not the organizer, we do not sell tickets, we do not handle registration, and we charge nothing for showing an event.
Marking "I’ll attend" on an event is an internal signal inside MyVisito: it saves the event to your own list and is counted anonymously. It does not register you for the event. To actually attend, register with the organizer through the event’s own page.
Event details (dates, times, venues, prices) come from the listings we collect. They may be incomplete or out of date, and may change after we collect them. Always verify the details with the organizer before making plans. Event names, brands, and content belong to their organizers, and showing an event is not an endorsement by us and does not imply any affiliation between us and the organizer.
If you are an organizer and want your event listed, corrected, or removed, or if you want to suggest an event, contact us at support@myvisito.com and we will handle it promptly. Members can also suggest events from inside the app; suggestions are reviewed before anything is added.
Reporting content, copyright, and our right to remove
We do not pre-screen or actively monitor the cards people create, and we are not responsible for user content. We are not obligated to monitor it, but we may review any card and, at our discretion, remove content, take a card offline, or suspend an account, for example where content appears to break these Terms or the law, or in response to a complaint.
We may use automated systems to help detect content that appears to violate these Terms. Content flagged this way is reviewed by a person before a final decision; in severe cases (for example sexual content, content endangering minors, or incitement to violence) the content may be taken offline immediately pending that review. If your content was affected and you believe it was a mistake, contact us at support@myvisito.com and we will take another look.
If you believe a card infringes your copyright, trademark, or other rights, uses your name, photo, or personal details without permission, or impersonates you, please contact us at support@myvisito.com with enough detail to identify the card and the issue (the card’s address, what the problem is, and how we can reach you). We will review reports and take appropriate action, which may include removing content, taking a card offline, or terminating the accounts of people who repeatedly infringe others’ rights.
Please make reports in good faith. Submitting a knowingly false or bad-faith report is itself a misuse of the service.
Plans and billing
- MyVisito has a permanent free plan. Your card stays online within the free tier limits (one published card, one language, and a small number of AI copilot requests to try; you can still create as many draft cards as you like). No credit card is required.
- On the free plan, your card and its QR code carry MyVisito branding: a "Created with MyVisito" footer on the card and the MyVisito logo at the center of the QR code. Paid plans can remove the footer and place your own logo in the QR code.
- Paid plans add more, such as additional published cards, extra or unlimited languages, a lead capture form, a product catalog with prices, a booking scheduler, payment links, an unbranded QR code with no footer, and a larger AI allowance.
- The Business and Enterprise plans are for teams and are billed per seat, with a minimum number of seats. Each seat is one authorized team member, and the number of cards your team can keep published at once matches the number of seats you buy. You can add seats at any time.
- Paid plans are billed monthly or yearly, in ILS for customers in Israel and in USD elsewhere. Current prices are shown on the pricing page, and prices may be exclusive of taxes such as VAT, which are added where required.
- Payments are processed securely by Stripe. Subscriptions renew automatically at the end of each billing period until you cancel.
- Every self-serve paid plan starts with a 7-day free trial, once per account. A payment method is required to start it, nothing is charged during the trial, and the first charge is made automatically when the trial ends unless you cancel before then. Canceling during the trial costs nothing: the plan stays active to the end of the trial and the account then returns to the free plan. Switching plans during the trial keeps the original trial end date.
- By subscribing, you authorize us and Stripe to charge your payment method automatically for each renewal, at the then-current price, until you cancel.
- You can cancel at any time. When you cancel a paid plan, your account returns to the free plan rather than being locked or deleted; any cards beyond the free limit go offline until you subscribe again. See our Cancellation and Refund Policy for details.
- If we change prices, the change applies from your next billing period, and we will notify you in advance.
- If a payment fails, we may retry it, and if it is not completed, paid features return to the free tier.
Referral program
- MyVisito offers a referral program: every account has a personal referral link, and published cards may carry it in the "Created with MyVisito" badge.
- When a new user signs up through your link, they get the standard signup experience, including the permanent free plan and the free trial on paid plans; the program grants them no separate discount. Rewards for you as a referrer are shown on the "Invite friends" screen, and enrolled affiliates earn cash commissions under the separate Affiliate Program Terms.
- Rewards apply only to genuinely new users. Signing up through your own link, creating accounts for yourself or fictitious people, or any other manipulation of the program is prohibited, and we may withhold or revoke rewards earned that way.
- Rewards are capped per rolling year (shown on the referral screen), are granted once per referred account, have no cash value, cannot be transferred, sold, or redeemed for money, and billing credits are applied automatically to future charges only.
- A reward for a paid purchase is granted when the payment is actually made; a free trial does not count until it converts to a paid subscription.
- We may modify, suspend, or end the referral program at any time. Credits and billing credits already granted remain yours.
Selling through MyVisito: you are the seller
MyVisito lets you offer products for sale from your card: digital files, online courses, memberships, paid sessions and bookings, event registrations, and physical products (the "shop"). This chapter applies whenever you sell through the service, in addition to the rest of these Terms.
- You are the seller of record for everything you sell. You alone are responsible for the creation, operation, promotion, sale, and delivery of your products and services, including fulfillment, quality, safety, returns, refunds, chargebacks, customer support, required legal disclosures, compliance with consumer-protection, e-commerce, and marketing laws in every jurisdiction where you offer or sell, fraudulent or unlawful transactions, and losses from currency conversion.
- MyVisito is not the seller of record, is not a party to any sale, and has no responsibility or liability toward your buyers. We provide the software that displays your products and connects to payment services, and nothing more.
- We do not verify sellers, do not review or approve products, and do not endorse anything sold through the service. Every product page names you as the seller.
- You confirm that you hold all rights needed for everything you sell or include: the files you deliver, course videos you embed (including videos hosted on third-party platforms, under their own terms), images, and text. Membership and community links (such as WhatsApp or Telegram groups) lead to communities that you run: you are responsible for them and for what happens in them.
- If you sell within a team workspace, any commission arrangement between the workspace and its members is your internal matter. The commission figures MyVisito displays are statistics only; MyVisito never calculates, holds, or pays commissions.
Payments, payouts, and platform fees
- Card payments are processed by Stripe through your own connected Stripe account, under Stripe's Connected Account Agreement and Stripe's own terms, in the countries where Stripe operates. Charges run directly on your account: the buyer pays you, not us.
- MyVisito never holds, receives, or transmits buyers' funds, and is not a payment processor, money transmitter, escrow service, or financial institution. Payouts, payout timing, reserves, and account reviews are controlled by Stripe or your payment provider under their own rules; if they pause payouts or freeze funds, that is between you and them, and we are not liable for it.
- We charge a platform fee per completed sale, as a percentage that depends on your plan, shown on the shop screen before you start selling. On Stripe payments the fee is collected automatically from each sale. Payment processing fees charged by Stripe or your provider are yours. Fee levels may change with notice; changes never apply retroactively to completed sales.
- Instead of Stripe you may connect your own payment provider account (such as PayPal, Cardcom, Tranzila, or UPay), attach your own external payment link, or arrange payment directly with the buyer (for example cash or bank transfer). In all of these, the payment runs entirely between you, your buyer, and your provider: MyVisito is not involved in the money, charges no platform fee on those payments, and has no ability to refund, reverse, or investigate them.
- Invoicing integrations connect your own invoicing account. Issuing lawful invoices and receipts to your buyers, and all tax-invoice compliance, is your responsibility.
Seller obligations, taxes, and reporting
- All taxes on your sales are yours: collecting and remitting VAT or sales tax where required, reporting your income, and any other tax obligation in the countries where you or your buyers are located. MyVisito does not calculate, collect, or remit taxes on your sales and does not provide tax advice.
- Tax documents, where applicable (such as IRS Form 1099-K), are issued by the payment processor that settles your funds, not by MyVisito. Where we or a payment provider are legally required to report seller information or sales totals to a tax or other authority (for example under US law or the EU DAC7 rules), you authorize that reporting, and we may collect the details needed for it.
- Statutory consumer rights, such as the 14-day right of withdrawal in the EU and the UK and the Israeli consumer cancellation right, apply to you as the seller where the law applies to your sale. You are responsible for honoring them, for publishing any refund or cancellation policy the law requires of you, and for the business disclosures the law requires (such as your identity and contact details).
- Buyer details we pass to you (name, email, phone, shipping address, and answers to your questions) are shared so you can fulfill the order. From that moment you are an independent data controller: you must protect that information, use it lawfully, honor buyers' privacy rights, and never use it for spam.
Prohibited products and commerce misuse
You may not sell, offer, or link to any of the following through the service:
- Anything illegal where you or your buyer are located, or that requires a license or authorization you do not hold.
- Adult content or services.
- Weapons, ammunition, explosives, or dangerous materials.
- Drugs, drug paraphernalia, pharmaceuticals, or products making unproven health or medical claims.
- Counterfeit, stolen, or infringing goods.
- Financial products or services, investment advice or schemes, cryptocurrency offerings, gambling, or lotteries.
- Multi-level marketing, pyramid or "get rich quick" schemes, or courses and products with misleading outcome or earnings claims.
- Hateful or violent merchandise.
- Anything on the prohibited or restricted business lists of Stripe or of the payment provider you use.
Our right to act on commerce violations
You may not misuse the commerce features, including structuring sales to avoid the platform fee, splitting one business across accounts to get around limits, or delivering something other than what the product page describes.
We may, at our sole discretion and with or without prior notice, remove products, disable buy buttons, suspend or end your access to the selling features, or take cards offline, including while we investigate a suspected violation, unusual buyer complaints, or a payment provider inquiry, and where Stripe or another provider requires it. We are not liable for sales you lose as a result of such an action taken in good faith.
Buying from sellers on MyVisito
This section applies to you when you buy something offered on a MyVisito card. By purchasing, you acknowledge that you are transacting directly with the seller named on the product page, not with MyVisito. MyVisito provides the technology that displays the product and connects to the payment service; it is not the seller and is not a party to the transaction.
The seller alone is responsible for the product: its description and accuracy, quality, safety, legality, delivery, support, warranties, cancellations, and refunds. Payment goes to the seller through the seller's own payment account or payment method; MyVisito never receives your money and cannot issue, process, or force a refund. For any issue, contact the seller first using the contact details on their card or on your order page; for card payments you can also contact the payment provider or your card issuer.
To the maximum extent permitted by law, you release EmodeFlow, LLC and its officers, employees, and agents from any claims, demands, and damages of every kind, known or unknown, arising out of or connected to a purchase from a seller or a dispute with a seller. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Nothing in this section limits the statutory rights consumer law gives you against the seller, or any mandatory right that cannot be waived under the law of your country.
Our intellectual property
The MyVisito platform, its name, logo, design, templates, and software remain the property of EmodeFlow, LLC and its licensors. These Terms do not grant you any right to the platform itself beyond using the service as permitted here.
If you send us feedback, ideas, or suggestions about the service, we may use them to operate and improve MyVisito without any restriction or obligation to you, and you are not entitled to any compensation for them.
Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that it will meet your requirements. You are responsible for keeping your own copies of important content. Nothing in this section limits warranties or rights that cannot be excluded under the law that applies to you.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the service.
Without limiting the above, and to the maximum extent permitted by law, we are not liable for the products and services that sellers offer or sell through the service, for the acts or omissions of any buyer or seller, for lost sales or earnings, or for the actions of payment providers, including declined payments, payout delays, reserves, or frozen funds.
To the maximum extent permitted by law, our total liability for any claim arising from or related to the service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or the mandatory rights that consumer protection law gives you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless EmodeFlow, LLC and its officers, employees, and agents from and against any claims, damages, losses, and reasonable costs (including reasonable legal fees) arising from or related to: the content you publish; your collection or use of lead details or other people’s data; your products and your sales through the service, including claims from buyers, chargebacks, refunds, taxes, non-compliance with laws or payment-network rules, fraud, incidents involving buyer data you hold, and any fees or penalties imposed by a payment provider, bank, or card network in connection with your sales; your breach of these Terms; or your violation of any law or the rights of any third party.
Suspension and termination
You may stop using the service and close your account at any time.
We may suspend or terminate your access if you breach these Terms, fail to pay, use the service to resell it or serve third parties outside your organization, use it to get around our pricing, use it in a way that creates risk or legal exposure, or where we are required to by law. Where reasonable, we will give you notice.
When your account ends, your published cards are taken offline, and you may request deletion of your data as described in our Privacy Policy. Sections that by their nature should survive termination (such as content ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) continue to apply.
Dispute resolution, arbitration, and class action waiver
Informal resolution first: before starting a formal dispute, please contact us at support@myvisito.com so we can try to resolve it. If we cannot resolve it within 30 days, either of us may proceed as set out below.
Binding individual arbitration: except as noted below, any dispute arising from or related to these Terms or the service will be resolved by binding arbitration administered by the American Arbitration Association under its applicable rules, rather than in court. Either party may still bring an individual claim in small claims court.
Class action waiver: disputes will be handled on an individual basis only. You and we waive the right to bring or participate in any class, collective, or representative action.
Your right to opt out: you may opt out of this arbitration agreement and class action waiver by emailing support@myvisito.com within 30 days of first accepting these Terms. Opting out does not affect the rest of these Terms.
Consumers in the EU/EEA, the UK, and Israel: this section does not apply to you. You keep the right to bring claims in the courts of your place of residence and to contact your local consumer or data protection authority, and nothing here limits the mandatory rights your local law gives you.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and those protections are not reduced by this choice of law.
General
- These Terms, together with our Privacy Policy and Cancellation and Refund Policy, are the entire agreement between us regarding the service.
- If any part of these Terms is found unenforceable, the rest stays in effect.
- Our not enforcing a term is not a waiver of it.
- We may assign these Terms as part of a merger, acquisition, or sale of assets; you may not assign them without our consent.
- We are not liable for delays or failures caused by events beyond our reasonable control.
- We may update these Terms from time to time. If we make material changes, we will take reasonable steps to let you know before they take effect. Continuing to use the service after a change means you accept the updated Terms.
