Terms of Service

These Terms of Service ("Terms") govern your access to and use of MyVisito, a digital business card service operated by EmodeFlow, LLC ("we", "us", "our"), a company registered in the United States. By creating an account or using the service you agree to these Terms.
Please read these Terms carefully. They include an arbitration agreement and a class action waiver in the "Dispute resolution" section that affect how disputes between us are resolved. If you are a consumer in the European Union or EEA, the United Kingdom, or Israel, that section does not limit the mandatory rights your local law gives you.
The service
MyVisito lets you create, edit, publish, and share digital business cards, including AI-assisted generation of card content and design. We keep improving the service, and we may add, change, or remove features over time. Where a change is significant, we will take reasonable steps to let you know.
Operating the service includes measuring how it is used while you are signed in, including recording how screens are used (clicks, scrolling, and movement between screens) with text you type and media you upload masked, so we can keep the service secure and improve it. This is described in more detail in our Privacy Policy.
Eligibility and your account
- You must be at least 16 years old to use MyVisito.
- Between 16 and 18 the service is the card only: creating, publishing and sharing cards. Hosting events, selling anything at all (products, digital files, courses, memberships, bookings and event tickets), buying a paid plan or any add-on, the paid referral program, and collecting money in any way, including collection outside our payment rails through your own payment link or a bank transfer, all require being 18 or older. The date of birth you give when you open your account is how we check this, and these parts of the service open on your 18th birthday.
- If you use MyVisito on behalf of a business or another person, you confirm that you are authorized to accept these Terms on their behalf.
- You must provide accurate information and keep your login credentials secure. Actions taken through your account are your responsibility.
- You may create as many draft cards as you like; how many you can keep published at once depends on your plan. On the Teams and Enterprise plans, each team member is an authorized user who occupies a paid seat. Your account and any seats are for you or your organization, and may not be sold, shared, rented, or transferred to others.
- You confirm that you are not located in, and are not on any sanctions or restricted-party list of, a country or territory subject to comprehensive government sanctions, and that you will not use the service in violation of any applicable export-control or sanctions laws.
- Your account and the public address (handle) of your cards are provided for your use of the service; you do not acquire ownership or any other property right in them. We may reclaim, change, or release a handle where it infringes someone else's rights, is used to impersonate, or is used in violation of these Terms, and where reasonable we will tell you first.
- Keep the email address on your account accurate and current. Notices we send to that address are considered delivered to you.
- If we learn that an account holder is under 16, we may close the account. If we learn that an account holder under 18 is selling, hosting events or collecting money, we may stop that activity or close the account.
Your content and the license you give us
You keep full ownership of the content you add to your cards. You grant us the limited, non-exclusive, worldwide, royalty-free license needed to host, store, display, and share that content so the service can function, and nothing more. This license ends when you delete the content or your account, except for copies we are required to keep by law or that remain in routine backups for a limited period.
You are responsible for the content you publish: that it is accurate, that you have the rights and any consents needed to use it (including for photos, logos, and any personal details of other people you add), and that it does not violate any law or the rights of others.
When visitors submit their details through a lead form on your card, you are the party responsible for that information (the data controller). You must have a lawful basis to collect and use it and, where the law requires, provide those visitors with your own privacy notice. We handle that information on your behalf, as described in our Privacy Policy.
When you import content into a card using a link, a photo, or a file (for example the import that builds a card from your existing website), you confirm that you own that content or are authorized to use it, and the imported result is treated as your content under this section.
AI-generated content
The copilot generates card content and design based on what you tell it. The same applies to every other AI feature in the service, including help with writing product descriptions and building course outlines in the shop. AI output is provided as is, may contain mistakes or inaccuracies, and does not constitute legal, financial, medical, or other professional advice. Review AI output before publishing or selling with it: you are responsible for everything that appears on your published card and product pages, including any claims they make.
The text, images, and files you provide to the copilot are sent to our AI provider only to produce the result you requested. They are not used to train AI models. Do not submit other people’s sensitive personal information to the copilot unless you are permitted to.
As between you and MyVisito, AI output generated for you is treated as your content: you may use it as part of your card, product pages, and other materials in the service, and it is covered by the same responsibilities and the same license you grant us for the rest of your content. This does not transfer to you any rights in the underlying AI models or in content owned by third parties that may appear in the output.
AI output is not guaranteed to be unique. Similar or identical output may be generated for other users from similar requests, and we make no promise of exclusivity in AI-generated text, designs, or ideas.
Acceptable use
We may suspend, limit, take cards offline on, or terminate any account that violates these rules, or that we reasonably believe is being used to resell the service, to serve third parties outside your organization, or to get around our pricing. Where the issue is not a security or legal risk, we will, where reasonable, warn you first and give you a chance to put it right, for example by moving to the correct plan or buying the seats your use needs. Where we reasonably suspect a serious breach, we may suspend access while we look into it.
- No impersonating another person or business, misrepresenting your affiliation, or publishing a card that carries the name, likeness, or contact details of a real person without their consent. Each card must represent you, or a person or organization you are authorized to represent.
- No unlawful, harassing, misleading, defamatory, hateful, or infringing content.
- No content promoting illegal goods or services, adult content, or anything that endangers minors.
- No spam, phishing, malware, or attempts to interfere with, overload, or disrupt the service or its security.
- No automated scraping, reverse engineering, or circumventing the limits or protections of the service.
- No using lead details or other people’s data collected through the service in a way that breaks the law or those people’s rights.
- No reselling, sublicensing, or offering the service to others as your own without our written permission.
- No operating the service as a service bureau, agency, or reseller to create, publish, or manage cards on behalf of people or businesses who are neither you nor paid members of your own workspace. Managing cards for your own team is fully supported on the Teams and Enterprise plans, where each team member occupies a paid seat you buy; serving third parties outside your organization requires a separate written agreement with us.
- No structuring your use to get around our pricing, for example using a single account or seat, or extra accounts, workspaces, or cards, to serve people who each should have their own plan or seat.
- Features described as "unlimited" are for normal use by you or your own team of the size you pay for, not for redistribution or resale. We may apply reasonable limits to use that is inconsistent with that.
Messaging guests and contacts
The service can send email, SMS and WhatsApp messages on your behalf, for example event invitations, RSVP confirmations, reminders, and updates. SMS and WhatsApp messages go out through MyVisito’s own sender identity. Email invitations, broadcasts and reminders to your guests go out under YOUR name, from an address on a dedicated MyVisito sending domain reserved for organizers, with replies routed to your own email address: you are the sender of record for those messages, and MyVisito is the platform that transmits them for you. The list of people you send to is your responsibility.
When you send email to your guests under your own name, the footer identifies the sender to them: your business name and the postal address you entered in your organizer or seller settings. Anti-spam laws require that identification on commercial mail, so supplying an accurate business name and postal address is your obligation, and we display them to your recipients for that purpose. Where you have not supplied them, guest email goes out under MyVisito’s own identification instead, and commercial email that legally requires yours may be held until you complete it.
Sending reputation on the shared organizer domain is shared between organizers. We may move an account to a different sending domain or tier, and we may require that campaigns to lists you bring with you be sent from a domain you own, or from your own marketing service, before they can go out at all.
- Only message people who gave you their contact details themselves, or who know you personally and expect to hear from you about the event. Purchased, rented, or automatically collected contact lists, and unsolicited bulk messaging of any kind, are prohibited.
- Text messages follow a stricter rule than email, because we cannot verify a claim that a list agreed. A contact you upload from a file, or type in yourself, can be reached by email through the service; a text message reaches only people who registered, bought, or subscribed through MyVisito themselves, and accepted these terms at that moment. The one exception is an invitation to a PRIVATE event, which is not commercial advertising: there you may text a guest list you supply, after a declaration in your own name from an account with a verified phone, within sending limits, and subject to monitoring. If your uploaded list produces an unusual rate of opt-outs or dead numbers, we close that door for your account and tell you why. Messages to guests who registered themselves are unaffected.
- If you want to run a campaign to a list you brought with you, connect your own email marketing service (for example Mailchimp, Klaviyo, MailerLite, Brevo, Kit or beehiiv) in the integrations screen and send from there, under your own sender identity and your own responsibility.
- Broadcast messages to event guests must be informational only and directly related to that event (for example a schedule change, venue update, arrival instructions, or safety information). Marketing, commercial, or promotional content of any kind is prohibited in guest broadcasts. Every broadcast passes an automated review before sending, we may hold a message for manual review, and we may decline to send a message that does not meet this definition.
- You are responsible for complying with the messaging and anti-spam laws that apply to you and your recipients (for example the Israeli anti-spam law, the TCPA in the United States, and similar laws elsewhere).
- Recipients can ask to stop receiving messages at any time, and we honor that request across the whole service: a phone number that opted out will not receive further messages from any account. Do not attempt to bypass an opt-out.
- We measure complaint, unsubscribe and bounce rates on every account automatically. When recipients report your messages as spam, or say when unsubscribing that they never signed up, sending may be paused without prior notice, and the account may be placed under review; the reason is shown in your account and you can respond there. We may also apply sending limits and quotas, limit, suspend, or block messaging for an account, and for repeated or serious abuse suspend the account itself.
- When a recipient unsubscribes they may tell us why, and we keep that answer (for example that they never signed up) together with the unsubscribe itself. That record is shown to you in your audience screen as a blocked contact, is used to protect the service, and cannot be cleared by you: a person who asked to stop hearing from you stays blocked for messages from your account.
- You will indemnify us for claims arising from messages you asked the service to send in breach of this section, as described in the Indemnification section.
Public cards, search engines, and third-party links
A card is public only when you choose to publish it. A published card lives at a public web address with no login required, so anyone who has the link, scans its QR code, or finds it online can view it and save its details.
When you first publish a card, you choose its search visibility, and you can change that choice at any time in the editor. The default is PUBLIC: search engines and other services (such as Google) may crawl, index, cache, and display the card and its content in search results, previews, link summaries, and archives, and social platforms and messaging apps may generate their own previews of it. This is a normal part of publishing on the web, and by publishing a card with the public setting you agree to it.
Published cards are also listed by default in the MyVisitors community directory on our site, a public gallery of members. The directory shows tile information only: your name, photo, job title, business field, and a link to your card. Contact details such as phone numbers and email addresses are not shown in the directory itself. You can remove your card from the directory at any time in the card editor's settings, and unpublishing a card removes it from the directory as well.
You can instead choose PRIVATE, for the whole time the card is published or starting at any later moment. Private means we ask search engines not to index the card (a standard "noindex" signal) and we leave it out of our sitemaps. Private is not a lock or a password: the card remains reachable by anyone who has its link or scans its QR code, and while mainstream search engines honor noindex signals, we cannot guarantee that every crawler or service will. If a card was public and indexed before you switched it to private, it may keep appearing in search results and caches for some time until search engines re-crawl and drop it.
Once a card is public, its content can also be viewed, copied, screenshotted, cached, or re-shared by other people and services, and copies may continue to exist elsewhere (for example in search-engine caches or web archives) even after you change, unpublish, or delete the card, or switch it to private. Those copies are outside our control and we cannot guarantee their removal.
You can unpublish a card at any time from your account. Unpublishing takes the card offline on our service and, over time, asks search engines to drop it, but removal from third-party caches, archives, and copies is up to those third parties, is outside our control, and is not something we promise. For that reason, do not put anything on a published card, about yourself or anyone else, that you are not comfortable being fully public.
We do not verify the identity of cardholders or the accuracy of the information on any card, and we do not endorse any card or the people or businesses behind them. Any dealings you have with a cardholder, or with a visitor who submits their details to your card, are between you and them and are at your own risk.
Cards can include links to third-party services, such as social profiles, booking pages, and payment links. We do not control or endorse those services, and we are not responsible for them. Your use of them is subject to their own terms.
The service can also connect to third-party tools you choose, such as CRM systems, spreadsheet and automation services, calendar and video-meeting services (Google Calendar, Google Meet, Zoom), and payment providers, and can show listings of third-party events. Those tools and events belong to their providers and organizers: their own terms and privacy policies govern them, we do not endorse them or guarantee their accuracy or availability, and data you choose to send to them leaves our service at your direction and under their policies.
When you connect a calendar or video-meeting account (Google Calendar, Zoom), the service creates, updates and cancels meetings, webinars and calendar entries in YOUR account, only for the sessions you sell, confirm or host through MyVisito, and delivers their join links to the people who registered or paid. It never reads your other calendars, recordings, chat or participant lists. Creating sessions automatically is part of the paid plans; a link you paste yourself works on every plan. You can disconnect at any time from Settings > Integrations or from the provider's own settings, after which we stop managing those sessions and delete the access tokens we held.
Event discovery
MyVisito includes an event discovery feed that shows professional events and meetups collected from publicly available listings around the web, with the name of the source and a link to the event’s own page. This section is about that feed of third-party events only; events that MyVisito members host through the service, including their ticket sales, are governed by the hosted-events section below. For the third-party events in the feed we are not the organizer, we do not sell tickets, we do not handle registration, and we charge nothing for showing an event.
Marking "I’ll attend" on an event is an internal signal inside MyVisito: it saves the event to your own list and is counted anonymously. It does not register you for the event. To actually attend, register with the organizer through the event’s own page.
For each event we keep only basic factual details (name, date, place, price, category) and the link to its own page; descriptions, registration, and ticket sales stay with the source. Event details (dates, times, venues, prices) come from the listings we collect. They may be incomplete or out of date, and may change after we collect them. Always verify the details with the organizer before making plans. Event names, brands, and content belong to their organizers, and showing an event is not an endorsement by us and does not imply any affiliation between us and the organizer.
If you are an organizer and want your event listed, corrected, or removed, or if you want to suggest an event, contact us at contact@myvisito.com and we will handle it promptly. Members can also suggest events from inside the app; suggestions are reviewed before anything is added.
Places and productions directory
MyVisito keeps a directory of places (clubs, bars, halls, restaurants, festival grounds and similar) and of productions, each with a page of its own on our site. A place's page is put together by MyVisito from publicly available sources, from the details members entered when they named the place on their own shows or events, and, once the place claims its page, from the place itself. Until it is claimed, the page is maintained by MyVisito and is not the place's official page: no affiliation, sponsorship or endorsement is implied in either direction.
A place's page shows factual details only (name, type, address, contact channels, a map) and the events that MyVisito members put on sale there. Those events are their organizers' own, are governed by the hosted-events section below, and the organizer alone is responsible for having the place's agreement. The details may be incomplete or out of date; verify them with the place before you rely on them. Place names and logos belong to their owners and appear only to identify the place. A "Verified place" mark means MyVisito checked the listed details, not that the owner endorses the page.
If you own or manage a place, you can claim its page with proof of ownership (for example an email address at the place's own domain), after which the page is yours to edit under these Terms, or you can ask us to correct or remove it. Anyone may report an error the same way. Write to contact@myvisito.com and we will act promptly. The rights-report process in the section below applies to place pages too. Where a page includes place or map data from OpenStreetMap, that data is © OpenStreetMap contributors and is available under the Open Database License.
API access and integrations
- MyVisito offers an API and integration apps (for example for automation platforms) on eligible plans. Your API keys are confidential: do not share them, publish them, or embed them where others can read them.
- Everything done with your API keys counts as done by your account, whether or not you authorized it, so store keys securely and rotate them if you suspect a leak. If you believe a key has been exposed or misused, revoke it in the app or contact us right away.
- We may apply reasonable rate and usage limits to API access, and we may suspend or revoke keys where needed to protect the service, its users, or our systems.
- API access is for your own account and workspace. Offering it to third parties as a standalone service, or reselling it, requires our written permission.
Reporting content, copyright, and our right to remove
We do not pre-screen or actively monitor the cards people create, and we are not responsible for user content. We are not obligated to monitor it, but we may review any card and, at our discretion, remove content, take a card offline, or suspend an account, for example where content appears to break these Terms or the law, or in response to a complaint.
We may use automated systems to help detect content that appears to violate these Terms. Content flagged this way is reviewed by a person before a final decision; in severe cases (for example sexual content, content endangering minors, or incitement to violence) the content may be taken offline immediately pending that review. If your content was affected and you believe it was a mistake, contact us at support@myvisito.com and we will take another look.
If you believe a card, product, or seller page infringes your copyright, trademark, or other rights, offers counterfeit goods, uses your name, photo, or personal details without permission, or impersonates you, please report it to us at contact@myvisito.com or through the contact form on our website. To let us handle your report quickly, include: the address (URL) of the infringing card, page, or product; which right is being infringed (for example copyright, trademark, counterfeit goods, or impersonation) and a description of the infringement; proof that you own the right, such as a trademark registration number or a link to the original work; your contact details; and a good-faith statement that the information in your report is accurate and that you are the rights holder or authorized to act on their behalf. We will review reports and take appropriate action at our discretion, including while a review is still ongoing. Action may include removing content, taking a card or seller page offline, or terminating the accounts of people who repeatedly infringe others’ rights. Where appropriate we will notify the affected seller, who may respond with evidence of their rights.
For copyright complaints under the U.S. Digital Millennium Copyright Act (DMCA), our designated agent is registered with the U.S. Copyright Office (registration DMCA-1079623): Copyright Agent, EmodeFlow LLC, 1111B S Governors Ave, STE 93153, Dover, DE 19904, USA, email contact@myvisito.com. A DMCA notice should include the elements listed above, and we handle such notices under the notice-and-takedown process described in this section, including our repeat-infringer policy.
Please make reports in good faith. Submitting a knowingly false or bad-faith report is itself a misuse of the service.
Plans and billing
- MyVisito has a permanent free plan. Your card stays online within the free tier limits (one published card, one language, and a small number of AI copilot requests to try; you can still create as many draft cards as you like). No credit card is required.
- On the free plan, your card and its QR code carry MyVisito branding: a "Created with MyVisito" footer on the card and the MyVisito logo at the center of the QR code. Paid plans can remove the footer and place your own logo in the QR code.
- Paid plans add more, such as additional published cards, extra or unlimited languages, a lead capture form, a product catalog with prices, a booking scheduler, payment links, an unbranded QR code with no footer, and a larger AI allowance.
- On the paid personal plans (Starter, Premium and Max), each plan includes a set number of published cards, and you can purchase additional published-card slots as an add-on for a recurring per-card price shown in the product. The add-on is billed as part of your existing subscription and renews with it. You can remove add-on slots at any time from the billing screen: removal takes effect immediately, the next renewal is billed accordingly, and no credit is given for the remainder of the current billing period. A slot in use by a published card must be freed (by unpublishing the card) before it can be removed, and add-on slots end automatically when the subscription ends. Team plans do not use this add-on; their published-card capacity is set by seats.
- The Teams and Enterprise plans are for teams and are billed per seat, with a minimum number of seats. Each seat is one authorized team member, and the number of cards your team can keep published at once matches the number of seats you buy. You can add seats at any time.
- Paid plans are billed monthly or yearly, in ILS for customers in Israel and in USD elsewhere. Current prices are shown on the pricing page, and prices may be exclusive of taxes such as VAT, which are added where required.
- Payments are processed securely by Stripe. Subscriptions renew automatically at the end of each billing period until you cancel.
- Every self-serve paid plan starts with a 14-day free trial, once per account. A payment method is required to start it, nothing is charged during the trial, and the first charge is made automatically when the trial ends unless you cancel before then. Canceling during the trial costs nothing: the plan stays active to the end of the trial and the account then returns to the free plan. Switching plans during the trial keeps the original trial end date.
- Team plans (Teams, Teams Plus, Teams Max) and Enterprise are not available through self-serve signup. They are opened by a personal, single-use invitation we send after we speak with you, which states the plan, the number of seats, the price and the trial length agreed for your organization. The free trial applies through that invitation on the same terms as above. Enterprise pricing is set per organization and is not published. A workspace already on a team plan continues to manage its own seats and to move between team tiers.
- By subscribing, you authorize us and Stripe to charge your payment method automatically for each renewal, at the then-current price, until you cancel.
- You can cancel at any time. When you cancel a paid plan, your account returns to the free plan rather than being locked or deleted; any cards beyond the free limit go offline until you subscribe again. See our Cancellation and Refund Policy for details.
- If we change prices, the change applies from your next billing period, and we will notify you in advance.
- If a payment fails, we may retry it, and if it is not completed, paid features return to the free tier.
Referral program
- MyVisito offers a referral program: every account has a personal referral link, and published cards may carry it in the "Created with MyVisito" badge.
- When a new user signs up through your link, they get the standard signup experience, including the permanent free plan and the free trial on paid plans; the program grants them no separate discount. Rewards for you as a referrer are shown on the "Invite friends" screen, and enrolled affiliates earn cash commissions under the separate Affiliate Program Terms.
- Rewards apply only to genuinely new users. Signing up through your own link, creating accounts for yourself or fictitious people, or any other manipulation of the program is prohibited, and we may withhold or revoke rewards earned that way.
- Rewards are capped per rolling year (shown on the referral screen), are granted once per referred account, have no cash value, cannot be transferred, sold, or redeemed for money, and billing credits are applied automatically to future charges only.
- A reward for a paid purchase is granted when the payment is actually made; a free trial does not count until it converts to a paid subscription.
- We may modify, suspend, or end the referral program at any time. Credits and billing credits already granted remain yours.
Selling through MyVisito: you are the seller
MyVisito lets you offer products for sale from your card: digital files, online courses, memberships, paid sessions and bookings, event registrations, and physical products (the "shop"). This chapter applies whenever you sell through the service, in addition to the rest of these Terms.
- You are the seller of record for everything you sell. You alone are responsible for the creation, operation, promotion, sale, and delivery of your products and services, including fulfillment, quality, safety, returns, refunds, chargebacks, customer support, required legal disclosures, compliance with consumer-protection, e-commerce, and marketing laws in every jurisdiction where you offer or sell, fraudulent or unlawful transactions, and losses from currency conversion.
- MyVisito is not the seller of record and is not a party to the sale between you and your buyer. We provide the software that displays your products and connects to payment services; on the MyVisito payments rail, we also collect and transfer proceeds and operate refunds, disputes, and risk controls as described below.
- Sellers who collect payments through MyVisito's payment rails undergo identity verification by the payment provider, and sellers who collect money for events record the responsible seller's details with us; paid events selling through MyVisito's payments rail are checked against our prohibited-content rules before going live, and other public content is screened automatically with human review of flags. None of this shifts your responsibility as the seller, and none of it is an endorsement, an approval, or a guarantee of you or of anything sold through the service. Every product page names you as the seller.
- You confirm that you hold all rights needed for everything you sell or include: the files you deliver, course videos you embed (including videos hosted on third-party platforms, under their own terms), images, and text. Membership and community links (such as WhatsApp or Telegram groups) lead to communities that you run: you are responsible for them and for what happens in them.
- When you sell tickets or collect payment for an event you host, you are the event's organizer and the seller of its tickets. You alone are responsible for the event itself: the venue, safety, licenses and permits, any age restriction you set, the accuracy of the event details, and honoring the cancellation policy you published alongside any statutory rights your buyers have. MyVisito provides the invitation page and the payment plumbing only, and is never the organizer of your event.
- If you sell within a team workspace, any commission arrangement between the workspace and its members is your internal matter. The commission figures MyVisito displays are statistics only; MyVisito never calculates, holds, or pays commissions.
Payments, payouts, and platform fees
- Card payments are processed by Stripe through your own connected Stripe account, under Stripe's Connected Account Agreement and Stripe's own terms, in the countries where Stripe operates. Charges run directly on your account: the buyer pays you, not us.
- Except on the MyVisito payments rail described below, MyVisito never holds, receives, or transmits buyers' funds, and is not a payment processor, money transmitter, escrow service, or financial institution. Payouts, payout timing, reserves, and account reviews are controlled by Stripe or your payment provider under their own rules; if they pause payouts or freeze funds, that is between you and them, and we are not liable for it.
- We charge a platform fee on sales processed through Stripe, as a percentage that depends on your plan (currently 9% on the free plan, 6.5% on Starter, 3.5% on the mid plans, and 0% on the Max plans; event tickets sold from a plan without shop selling carry a 5% platform fee), shown on the shop screen before you start selling; the fee is collected automatically from each Stripe sale. On top of it, Stripe (or your provider) charges its own payment processing fees, typically a percentage plus a fixed amount that varies by country and card type, billed by them to your account; currency-conversion costs, where applicable, are also theirs. Fee levels may change with notice; changes never apply retroactively to completed sales.
- Where MyVisito offers additional payment methods, you may connect your own payment provider account (such as PayPal or an Israeli provider), attach your own external payment link, or arrange payment directly with the buyer. The set of available payment methods may change; currently new sales run through Stripe (your own account, or the MyVisito payments rail described below). In all of these, the payment runs entirely between you, your buyer, and your provider: MyVisito is not involved in the money, charges no platform fee on those payments, and has no ability to refund, reverse, or investigate them.
- Where you collect payments directly (your own external payment link or bank-transfer instructions), the entire transaction is your undertaking alone. Guest "I paid" reports shown in the product are unverified statements made by the guest; a registration is marked paid only by your own confirmation, and MyVisito never verifies, holds, or guarantees those payments. Invoices, receipts, refunds, cancellations, registration changes and transfers, and buyer support on such events are handled by you, directly with your guests. Enabling any form of payment collection, including direct collection, confirms that you are at least 18 years old and entitled to collect those payments under the law that applies to you. The 18 requirement is about who holds a MyVisito account and hosts the event. Your guests are your audience and not MyVisito account holders, and any age condition for attending your event is yours to set and to enforce at the door.
- Invoicing integrations connect your own invoicing account. Issuing lawful invoices and receipts to your buyers, and all tax-invoice compliance, is your responsibility.
Payments processed through MyVisito (sellers without their own processor)
Where a seller cannot open a payment account of their own (currently sellers in Israel), we may offer to collect buyer payments through MyVisito's own payment account instead. This section applies only to sales processed on that rail, and only after you have expressly enabled it and accepted these terms in the product.
- By enabling this option you appoint MyVisito as your limited payment collection agent: we collect buyer payments on your behalf, and a buyer's payment to us counts as payment to you for the amount collected.
- The total fee on these sales is itemized in two parts, shown to you before you connect: MyVisito's own platform fee by plan (currently 3.5%, or 0% on the Max plans) plus a 7.5% costs component covering the third-party charges on this rail, payment processing, currency conversion, and the international transfer, charged by the payment processor and the banks. The total is therefore 11% (7.5% on the Max plans, where only the costs component remains, and 12.5% for event tickets sold from a plan without shop selling), and nothing beyond it is deducted. For event tickets, where you choose to pass the fees to the buyer, this same itemized total is added at checkout as a single service-fee line paid by the buyer instead of being deducted from your proceeds. Payments are collected in the buyer's purchase currency and your proceeds are paid in Israeli shekels; exchange rates are set by the payment processor at conversion time.
- Your proceeds, minus the platform fee and any deductions under this section, are transferred to your verified bank account automatically once a week (every Monday), after a safety hold set by the product's cancellation policy (currently 14 days from the sale when no policy was chosen, 3 days on a product sold without a money-back promise, or the money-back window you chose). For sales with a known delivery date (a scheduled meeting or an event), the hold extends until after the session took place plus a short complaint window. There is currently no transfer minimum: any available balance goes out on the next transfer. If a minimum is set in the future it will be stated in the Commerce Rules, and a smaller balance will accrue toward the next transfer. A transfer is sent from our US Stripe account; it typically leaves Stripe within a few business days of being sent, and your bank shows it within a further 2 to 3 business days (up to about 7 business days end to end). The exact dates appear on the finance screen. New sellers: until your first transfer has been paid and 30 days have passed since your first sale, a digital product or course sale is held until 7 days after the buyer first opened the content (and never less than the product's cancellation policy), or 14 days from the purchase when the buyer never opened it; your first transfer is reviewed by us before it is released; a buyer report from the order page that a digital product or course was not delivered holds that sale until you answer (mark it delivered, or refund); this is the standard practice of payment services worldwide. Where you sell through your own Stripe account, Stripe applies its own first-payout hold (typically 7 to 14 days) under its rules.
- Refunds on this rail are at your discretion, subject to the legal floors the system enforces automatically per the Commerce Rules: a buyer may cancel a meeting or an event up to 72 hours before the session, and return a physical product within 14 days. Instantly delivered digital products carry no cancellation right; at checkout the buyer agrees to immediate delivery and waives the withdrawal right. Where a refund is issued (by you, or automatically within a legal right), the refunded seller share is deducted from held or future proceeds.
- Buyers contact you from their order page. A request within an active legal cancellation right must be approved or denied within 7 days; such a request left unanswered is approved automatically on your behalf and refunded, with no cancellation fee. Any other request is yours to decide, including goodwill refunds.
- Sales on this rail are also governed by the Commerce Rules published at myvisito.com/commerce-rules, which set the payment and cancellation terms per product type and the prohibited-products list. The Commerce Rules form part of these Terms; on conflict regarding this rail, the Commerce Rules control.
- Chargebacks, dispute fees, and fraud losses on these sales are deducted from your held or future proceeds. We may reverse a transfer already sent, pause payouts while a dispute or a fraud review is open, apply transaction limits to new sellers, and hold a reserve where risk requires it.
- If refunds, chargebacks, or losses exceed your available proceeds, the difference becomes a debt deducted from future payouts; if it remains outstanding, we may collect it by other lawful means.
- We monitor activity on this rail for fraud, prohibited products, and unusual patterns. On reasonable suspicion of fraud, a prohibited product, or a failure to meet these Terms or the Commerce Rules, or where Stripe, card networks, banks, or the law require it, we may freeze your account and held funds, delay transfers, request documents and information, refund buyers, refuse or limit service, and report to payment partners or authorities, with or without prior notice. Funds released from a review, after permitted deductions, are transferred to you.
- We may modify, suspend, or discontinue this payment rail with reasonable notice (or immediately where the law or our payment partners require it), may require re-verification at any time, and may offset any amount you owe us under these Terms (refunds, chargebacks, fees, or damages) against held or future proceeds.
- This rail relies on third-party providers, including Stripe and banking systems. We are not liable for their decisions, delays, outages, or requirements. Where a third party blocks, delays, or reverses a payment or transfer, our obligation is limited to passing on to you what we actually receive.
- Identity verification and bank details are collected by Stripe on our behalf; we never store your bank account number or identity documents. We may decline, suspend, or close this payment option for any seller, including where Stripe, card networks, or the law require it; remaining proceeds after the hold and permitted deductions are then transferred to you.
- Your obligations as a seller are unchanged: the products remain yours, and taxes, invoices, and receipts to buyers remain your responsibility.
- Regulatory status: activity on this rail is exempt from an Israeli payment-services license under the Regulation of Payment Services and Payment Initiation (License Exemption) Regulations, 5784-2024 (low activity volume exemption), and is therefore not supervised by the Israel Securities Authority.
Hosted events and ticket sales
This section applies when you host an event through the service and collect registrations or sell tickets, in addition to the seller chapter above. Selling paid tickets requires an eligible plan, a business event, a connected payout method, your acceptance of the organizer terms inside the product, and a published cancellation policy for the event.
- A ticket is a personal, revocable license to attend your event, not a good. You control admission: you may refuse or revoke entry for good cause (safety, disruptive behavior, or failure to meet a condition you stated in advance, such as an age restriction), and in that case any remedy the buyer has is against you, under your policy and the law.
- If you turn on manual approval of registrations, buyers are charged at purchase and their registration is held for your decision; tickets are issued only on approval. You must decide within a reasonable time. Declining a registration, and any registration still undecided when the event starts, triggers an automatic full refund to the buyer. The decision to approve or decline, and its stated reason, are yours as the organizer, and buyers are told exactly that.
- Before you start selling tickets you must hold every license, permit, insurance, and authorization the event requires (venue, safety, alcohol, music rights, and similar), keep them in force for the life of the event, and be able to show them to us on request. An age restriction you set is yours to enforce at the door.
- Your published cancellation policy, together with your buyers' statutory rights, governs ticket cancellations. Buyers send cancellation requests from their order page, and you must answer within the times the Commerce Rules set. A no-show is not a cancellation: a buyer who simply does not attend is not entitled to a refund unless your policy says otherwise.
- If you cancel the event, every ticket buyer is entitled to a full refund. Cancelling an event in the service triggers automatic refunds of its ticket orders and an automatic notice to your guests: on the MyVisito payments rail we refund from your held or future proceeds, and where you sell through your own connected payment account we instruct the refunds on that account. If a refund cannot be completed from your balance, the shortfall becomes a debt you owe under these Terms.
- If you materially change the event (a new date, a new venue, or a comparable change), you must notify your guests promptly through the service, and a buyer who cannot attend the changed event is entitled to a refund on request within a reasonable time after your notice.
- Once the event has taken place as scheduled, the ticket sale is considered delivered. On the MyVisito payments rail, ticket proceeds are held until after the event date plus a short complaint window and are then included in the regular weekly transfer; where you sell through your own Stripe account, funds and payout timing are governed by Stripe and your agreement with them.
- For paid tickets you choose who carries the fees: either the platform fee and payment costs are deducted from the ticket price you set, or checkout adds a single service-fee line on top of the ticket price, paid by the buyer, shown before payment, and sized to cover the platform fee and the payment processing and currency-conversion costs of your sales rail. Where those third-party costs can only be estimated (sales through your own connected payment account), the estimate is deliberately conservative and any difference stays in your favor; the buyer is never charged more than the total shown at checkout. When a ticket order is refunded, the service fee charged on it is refunded with it, proportionally on a partial refund.
- Tickets are issued as personal QR codes that admit their holder at the door. Organized resale or scalping of tickets is prohibited; whether an individual buyer may pass a ticket to someone else is your decision as the organizer.
- As the seller of record you provide your legal name, for a business its registration number, your address and country, and your date of birth (collecting payments requires being 18 or older). Your legal name and registration number are shown to buyers at checkout and on the purchase confirmation and receipt, and if a paid event is cancelled, guests receive the seller's details. Buyers' claims about the event and its tickets run against you, identified by these details.
- If tickets were sold and no entries were recorded at the door, we may ask you to confirm that the event took place. Your confirmation inside the service is a binding representation under these Terms; a false confirmation is fraud and may lead to withheld payouts, termination, refunds to buyers, and reporting to payment partners and authorities. Where buyer complaints are open, the payout for the event may be withheld until they are resolved.
- Chargebacks and payment disputes on ticket sales are yours, like any other sale under these Terms.
- Your event page must describe the event truthfully: the date, the venue, the program, and who is performing or presenting. Selling tickets to an event that does not exist, or that you have no authority to sell for, is fraud and leads to immediate termination, refunds to buyers, and reporting to payment partners and authorities.
- Featuring an event in event discovery, in the community picks rail, on the public events board or on any other curated surface is at our discretion. It is not a promise, it is not paid placement, and it is not an endorsement of you or your event. We may change or withdraw it at any time, and it creates no entitlement, refund claim or compensation.
Seller obligations, taxes, and reporting
- All taxes on your sales are yours: collecting and remitting VAT or sales tax where required, reporting your income, and any other tax obligation in the countries where you or your buyers are located. MyVisito does not calculate, collect, or remit taxes on your sales and does not provide tax advice.
- Tax documents, where applicable (such as IRS Form 1099-K), are issued by the payment processor that settles your funds, not by MyVisito. Where we or a payment provider are legally required to report seller information or sales totals to a tax or other authority (for example under US law or the EU DAC7 rules), you authorize that reporting, and we may collect the details needed for it.
- Statutory consumer rights, such as the 14-day right of withdrawal in the EU and the UK and the Israeli consumer cancellation right, apply to you as the seller where the law applies to your sale. You are responsible for honoring them, for publishing any refund or cancellation policy the law requires of you, and for the business disclosures the law requires (such as your identity and contact details).
- Buyer details we pass to you (name, email, phone, shipping address, and answers to your questions) are shared so you can fulfill the order. From that moment you are an independent data controller: you must protect that information, use it lawfully, honor buyers' privacy rights, and never use it for spam.
Prohibited products and commerce misuse
You may not sell, offer, or link to any of the following through the service:
- Anything illegal where you or your buyer are located, or that requires a license or authorization you do not hold.
- Adult content or services.
- Weapons, ammunition, explosives, or dangerous materials.
- Drugs, drug paraphernalia, pharmaceuticals, or products making unproven health or medical claims.
- Counterfeit, stolen, or infringing goods.
- Financial products or services, investment advice or schemes, cryptocurrency offerings, gambling, or lotteries.
- Multi-level marketing, pyramid or "get rich quick" schemes, or courses and products with misleading outcome or earnings claims.
- Hateful or violent merchandise.
- Anything on the prohibited or restricted business lists of Stripe or of the payment provider you use.
Our right to act on commerce violations
You may not misuse the commerce features, including structuring sales to avoid the platform fee, splitting one business across accounts to get around limits, or delivering something other than what the product page describes.
We may, at our sole discretion and with or without prior notice, remove products, disable buy buttons, suspend or end your access to the selling features, or take cards offline, including while we investigate a suspected violation, unusual buyer complaints, or a payment provider inquiry, and where Stripe or another provider requires it. We are not liable for sales you lose as a result of such an action taken in good faith.
Buying from sellers on MyVisito
This section applies to you when you buy something offered on a MyVisito card. By purchasing, you acknowledge that you are transacting directly with the seller named on the product page, not with MyVisito. MyVisito provides the technology that displays the product and connects to the payment service; it is not the seller and is not a party to the transaction.
The seller alone is responsible for the product: its description and accuracy, quality, safety, legality, delivery, support, warranties, cancellations, and refunds. On most sales, payment goes to the seller through the seller's own payment account or payment method, and MyVisito does not receive your money and cannot issue, process, or force a refund. On sales processed through MyVisito's payments rail (marked at checkout and on your order page), MyVisito collects the payment as the seller's limited collection agent and applies the published refund policy and the Commerce Rules. For any issue, contact the seller first using the contact details on their card or on your order page; for card payments you can also contact the payment provider or your card issuer.
Event tickets you buy through the service are personal licenses to attend, granted by the event's organizer. Entry can be conditioned on the rules the organizer stated in advance, such as an age restriction, and the organizer may refuse or revoke entry for good cause. Not attending is not a cancellation and does not by itself entitle you to a refund. Cancellations follow the organizer's published policy alongside your statutory rights, and you can send a cancellation request from your order page. If the organizer cancels the event, you are entitled to a full refund of the ticket price. Some organizers add a service fee on top of the ticket price; it appears as its own line before you pay, and the total shown at checkout is the total you are charged. A refund of a ticket order includes the service fee charged on it, proportionally when only part of the order is refunded, and if the organizer cancels the event you receive back everything you paid, the service fee included.
To the maximum extent permitted by law, you release EmodeFlow, LLC and its officers, employees, and agents from any claims, demands, and damages of every kind, known or unknown, arising out of or connected to a purchase from a seller or a dispute with a seller. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Nothing in this section limits the statutory rights consumer law gives you against the seller, or any mandatory right that cannot be waived under the law of your country.
A plain-language summary of this section for buyers is published on the Purchase Terms page (myvisito.com/en/purchase-terms); on any conflict, these Terms govern. When you register for or buy a ticket to a business event, you join the organizer's updates list and MyVisito's events updates list, as stated on the registration and checkout screens before you send; every such message carries a one-click unsubscribe, your choice is kept, and registering for a private event never adds you to any mailing list.
Our intellectual property
The MyVisito platform, its name, logo, design, templates, and software remain the property of EmodeFlow, LLC and its licensors. These Terms do not grant you any right to the platform itself beyond using the service as permitted here.
If you send us feedback, ideas, or suggestions about the service, we may use them to operate and improve MyVisito without any restriction or obligation to you, and you are not entitled to any compensation for them.
Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that it will meet your requirements. You are responsible for keeping your own copies of important content. Nothing in this section limits warranties or rights that cannot be excluded under the law that applies to you.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the service.
Without limiting the above, and to the maximum extent permitted by law, we are not liable for the products and services that sellers offer or sell through the service, for the acts or omissions of any buyer or seller, for lost sales or earnings, or for the actions of payment providers, including declined payments, payout delays, reserves, or frozen funds.
To the maximum extent permitted by law, our total liability for any claim arising from or related to the service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or the mandatory rights that consumer protection law gives you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless EmodeFlow, LLC and its officers, employees, and agents from and against any claims, damages, losses, and reasonable costs (including reasonable legal fees) arising from or related to: the content you publish; your collection or use of lead details or other people’s data; your products and your sales through the service, including claims from buyers, chargebacks, refunds, taxes, non-compliance with laws or payment-network rules, fraud, incidents involving buyer data you hold, and any fees or penalties imposed by a payment provider, bank, or card network in connection with your sales; your breach of these Terms; or your violation of any law or the rights of any third party.
Suspension and termination
You may stop using the service and close your account at any time.
We may suspend or terminate your access if you breach these Terms, fail to pay, use the service to resell it or serve third parties outside your organization, use it to get around our pricing, use it in a way that creates risk or legal exposure, or where we are required to by law. Where reasonable, we will give you notice.
We may also suspend or close an account that was opened with false details, or that we reasonably believe was created to get around a previous termination.
Placing an account under review: where we reasonably suspect fraud, a payment method that is not the account holder's, or a serious breach of these Terms, we may temporarily lock access to the account while we look into it. During a review nothing is deleted, cards you already published stay online, and you can reach us from the screen shown when you sign in. We will tell you by email that the account is under review and why, and access is restored as soon as the review is complete.
Identity verification as a condition of restoring access: where the concern is whether the account is really yours, we may ask you to verify your identity before we restore access. Verification is performed by Stripe on their own secure page; we receive only the result of the check, and we never receive or store your identity document, your photo, or your identity number. If we ask for verification and do not receive it within a reasonable time, we may keep the account locked or close it. Routine accounts are not asked to verify: this applies only where a specific risk was identified.
If we terminate your account for breaching these Terms, you may not sign up again or use the service through another account without our permission. Amounts already paid are not refunded when we terminate for cause, except where the law gives you a right to a refund.
When your account ends, your published cards are taken offline, and you may request deletion of your data as described in our Privacy Policy. Sections that by their nature should survive termination (such as content ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) continue to apply.
Dispute resolution, arbitration, and class action waiver
Informal resolution first: before starting a formal dispute, please contact us at contact@myvisito.com so we can try to resolve it. If we cannot resolve it within 30 days, either of us may proceed as set out below.
Binding individual arbitration: except as noted below, any dispute arising from or related to these Terms or the service will be resolved by binding arbitration administered by the American Arbitration Association under its applicable rules, rather than in court. Either party may still bring an individual claim in small claims court.
Class action waiver: disputes will be handled on an individual basis only. You and we waive the right to bring or participate in any class, collective, or representative action.
Your right to opt out: you may opt out of this arbitration agreement and class action waiver by emailing contact@myvisito.com within 30 days of first accepting these Terms. Opting out does not affect the rest of these Terms.
Consumers in the EU/EEA, the UK, and Israel: this section does not apply to you. You keep the right to bring claims in the courts of your place of residence and to contact your local consumer or data protection authority, and nothing here limits the mandatory rights your local law gives you.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and those protections are not reduced by this choice of law.
Changes to these Terms
We may update these Terms at any time, for example when we add features, change our plans, or need to reflect legal or regulatory changes. The current version is always available at myvisito.com/terms, with its "Last updated" date at the top.
If a change is material, we will notify you before it takes effect, by email to your account address, by a notice inside the service, or both, and where reasonable we will give you at least 14 days' advance notice. A change required by law, or needed urgently for security or to prevent abuse, may take effect sooner. Changes apply to new users from signup.
If you keep using the service after an updated version takes effect, that means you accept it. If you do not agree to a change, stop using the service and close your account before the change takes effect. We may also ask you to confirm your acceptance of updated Terms inside the service before continuing to use it.
Changes to the "Dispute resolution, arbitration, and class action waiver" section have their own rule: we will notify you of any material change to it, and you may reject that change by emailing contact@myvisito.com within 30 days of the notice, in which case the previous version of that section keeps applying to you.

General
- These Terms, together with our Privacy Policy and Cancellation and Refund Policy, are the entire agreement between us regarding the service.
- If any part of these Terms is found unenforceable, the rest stays in effect.
- Our not enforcing a term is not a waiver of it.
- We may assign these Terms as part of a merger, acquisition, or sale of assets; you may not assign them without our consent.
- We are not liable for delays or failures caused by events beyond our reasonable control.
- We may provide notices and other communications electronically, in the service or to your account email address, and they satisfy any requirement that a communication be in writing.
